Khalifrex Global Services Limited ("Khalifrex", "we", "us") provides website features, applications, and other products and services to you when you visit or shop at khalifrex.com or use Khalifrex applications (collectively, "Khalifrex Services"). By using the Khalifrex Services, you agree, on behalf of yourself and anyone who uses the Khalifrex Services under your account, to these Conditions of Use. Please read them carefully.

Electronic Communications
When you use the Khalifrex Services or send emails or other communications to us from your device, you are communicating with us electronically, and you consent to receive communications from us electronically, including by email, notifications, and messages on the site. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.
Copyright and Trademarks
All content included in or made available through the Khalifrex Services, including text, graphics, logos, icons, images, and software, is the property of Khalifrex or its content suppliers and is protected by Nigerian and international copyright laws. The Khalifrex name, logo, and other Khalifrex marks may not be used in connection with any product or service that is not Khalifrex's, or in any manner likely to cause confusion among customers or that disparages Khalifrex. All other trademarks appearing on the Khalifrex Services are the property of their respective owners.
License and Access
Subject to your compliance with these Conditions of Use and payment of any applicable fees, Khalifrex grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal, non-commercial use of the Khalifrex Services. This license does not include: any resale or commercial use of the Khalifrex Services or their contents; any collection or use of product listings, descriptions, or prices; any derivative use of the Khalifrex Services or their contents; any downloading or copying of account information for the benefit of a third party; or any use of data mining, robots, scrapers, or similar data gathering or extraction tools. You may not use any content from the Khalifrex Services to develop, train, or improve any machine learning or artificial intelligence model. You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information of Khalifrex without our express written consent. Any unauthorized use terminates the license granted here. All rights not expressly granted to you are reserved by Khalifrex and its licensors.
Your Account
You may need a Khalifrex account with a valid payment method to use certain Khalifrex Services. You are responsible for maintaining the confidentiality of your account and password, for restricting access to your account, and for all activities that occur under your account. You must be at least 18 years of age to use the Khalifrex Services. Khalifrex reserves the right to refuse service, close accounts, remove or edit content, or cancel orders at its sole discretion, including where we suspect fraud, abuse, or a violation of these Conditions of Use.
Reviews, Comments, and Other Content
You may post reviews, comments, photos, and other content, and submit suggestions, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable, and does not contain software viruses, commercial solicitation, or any form of spam. You may not use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of any content. Khalifrex reserves the right (but not the obligation) to remove or edit such content.
If you post content or submit material, you grant Khalifrex a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media, and to use the name you submit in connection with it. You represent that you own or control all rights to the content you post, that it is accurate, and that its use will not violate this policy or cause injury to any person or entity, and you agree to indemnify Khalifrex for all claims resulting from content you supply.
Third-Party Sellers
Khalifrex is a marketplace. Products offered on the Khalifrex Services are sold by independent third-party sellers, not by Khalifrex. When you purchase from a third-party seller, your contract of sale is with that seller. Khalifrex provides the platform, processes payment on the seller's behalf, and facilitates delivery, returns, and buyer-seller communication, but Khalifrex is not the seller of record and does not warrant the offerings of any seller. Khalifrex does not assume responsibility or liability for the actions, products, or content of sellers or other third parties.
Risk of Loss
All purchases of physical items made through the Khalifrex Services are made pursuant to a shipment contract. Risk of loss and title for items pass to you upon delivery to the carrier, except where applicable consumer protection law provides otherwise.
Returns and Refunds
Returns and refunds are handled through your Khalifrex account in accordance with the return policy displayed for the relevant seller and listing. Approved refunds are issued to your original payment method. Title to a returned item does not pass back to the seller until it is received and accepted. At our or the seller's discretion, a refund may be issued without requiring a return.
Product Descriptions and Pricing
Khalifrex and its sellers attempt to be as accurate as possible, but we do not warrant that product descriptions, prices, or other content on the Khalifrex Services are accurate, complete, reliable, current, or error-free. All prices are displayed in the currency of the applicable Khalifrex marketplace. Despite best efforts, a small number of items may be mispriced. If the correct price of an item is higher than the stated price, we or the seller may, before shipment, either contact you for instructions or cancel the order and notify you of the cancellation. Your payment method is generally not charged until your order enters processing.
Intellectual Property Complaints
Khalifrex respects the intellectual property of others. If you believe your intellectual property rights are being infringed on the Khalifrex Services, send a written claim to copyright@khalifrex.com including: a description of the protected work; the location of the allegedly infringing material on the site; your name, address, phone number, and email; a statement of your good-faith belief that the disputed use is not authorized; and a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rights owner or authorized to act on the owner's behalf. We respond promptly to the concerns of rights owners and terminate repeat infringers in appropriate circumstances.
Disclaimer of Warranties and Limitation of Liability
THE KHALIFREX SERVICES AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS, AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE KHALIFREX SERVICES ARE PROVIDED BY KHALIFREX ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. TO THE FULLEST EXTENT PERMITTED BY LAW, KHALIFREX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE KHALIFREX SERVICES, INCLUDING DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING. NOTHING IN THESE CONDITIONS EXCLUDES OR LIMITS ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE NIGERIAN CONSUMER PROTECTION LAW.
Disputes and Applicable Law
By using the Khalifrex Services, you agree that the laws of the Federal Republic of Nigeria, without regard to principles of conflict of laws, govern these Conditions of Use and any dispute that might arise between you and Khalifrex. Any dispute or claim relating in any way to your use of the Khalifrex Services will be adjudicated in the courts of Taraba State, Nigeria, and you consent to the exclusive jurisdiction and venue of those courts.
Site Policies, Modification, and Severability
Please review our other policies posted on this site, including the Privacy Notice and Cookies Notice. These policies also govern your use of the Khalifrex Services. We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. If any of these conditions is deemed invalid, void, or unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of the remaining conditions.
